1About these terms
These terms apply to anyone who uses the website or the portals of National Credit Intelligence ("the registry", "we"). A member institution's use of the registry is also governed by its participation agreement with the registry; where the two differ, the participation agreement applies. By using the website or the portals, you accept these terms.
2The website
The website describes the registry and how it works, and lets licensed institutions apply for membership and anyone contact the registry. It is information only: it is not an offer of credit, and the registry does not lend. The example report and the rating scale on the website illustrate how the registry works; they describe no real person.
3Membership
Membership is open to any licensed institution that extends credit in Somalia. Sending the application form starts the process; it does not make an institution a member. The registry reviews each application, and an institution becomes a member when it signs the participation agreement and its administrator's account is opened.
4Access to the portals
- The portals are open only to the staff of members and of the registry, each with a named account issued by their institution's administrator or by the registry.
- An account is personal. Do not share it, and keep its password secret; a temporary password must be changed at the first sign-in.
- Everything done in the portals is recorded with the user, the time and the address it came from.
- Tell your administrator, or the registry, at once if you think someone else has used your account.
5The permitted purpose
A member may ask the registry about a person only when that person has applied to it for credit and has signed their consent, or, for a loan granted before the member joined, has signed a registry consent. Asking for any other reason, such as marketing, employment screening or curiosity, is not permitted. Misuse of registry data is a sanctionable offence.
6Confidentiality
A report and its rating are confidential to the member that asked, for the application it asked about. The member may not pass them on to anyone else. The other members appear in a report only as Member A, Member B and so on, and a member may not try to find out who they are. A member that is asked about a person may use what it learns from the request only to answer it.
7Members' reporting
- Answer the registry's requests truthfully and completely, within one business day: every loan and guarantee the member holds on the person, now or at any time before.
- Report every live loan each month: the report for a month is due by the 5th of the next month.
- Correct a mistake as soon as it is found, and within 10 business days when a person asks.
8The report and the rating
The report puts together what the members answered: the registry never answers for a member. The rating is worked out from them by one published method, the same for everyone: a score out of 100 and one of fifteen grades, from A+ to E−, with its reasons. A person who has never taken a loan is not rated.
The report and the rating are information for the member's decision, not a decision: the registry never approves or refuses a loan, and the member decides on its own checks.
9Corrections
A person who believes something reported about them is wrong can ask for it to be corrected, through any branch of the member that reported it or with the registry. The member checks it against its own books and, when it is wrong, corrects it within 10 business days. Every correction is logged.
10Suspension and termination
The registry may suspend a member, or close a user's account, for a breach of these terms or of the participation agreement, or to protect the registry's information. A suspended member's users are signed out and cannot sign in until the member is reinstated.
11Liability
The registry takes care to keep its information accurate, and checks each report before it is accepted, but it relies on what its members report. It is not responsible for a member's decision to lend or not to lend, and it does not guarantee that any loan will be repaid.
12Our name and content
The registry's name, mark, website and portals belong to the registry. You may not copy them, or present anything as coming from the registry, without its written permission.
13Changes and governing law
We may update these terms. The date at the top shows when they last changed, and members are told of any change that affects them. These terms are governed by the laws of the Federal Republic of Somalia.
14Contact
For a question about these terms, write to us through the contact form, or use the registry's details below. How the registry handles personal information is set out in its Privacy Policy.
